Terms of Service

These terms govern your use of DirtFlow ("DirtFlow", "we", "us") at dirtflow.app. By creating an account or posting a listing, you agree to them. If you don't agree, please don't use DirtFlow. Our Privacy Policy explains how we handle your information.

1. What DirtFlow is

DirtFlow is an online listing board. Contractors use it to post earthwork material they have available (export) or need (import), and to find each other. DirtFlow is not a party to any deal between users. We do not buy, sell, broker, haul, test or inspect material, and we do not verify listings or users. When one user asks to reach another about a listing, we may pass the request on.

2. Your account

• You must be at least 18 and use DirtFlow for business purposes.
• Give accurate information, keep your sign-in details secure, and tell us if you think someone else is using your account.
• You are responsible for everything done through your account.

3. Your listings

• Only list material you have the right to offer, or a need that is real.
• Describe the material, volume, location and timing accurately, and remove a listing once it no longer applies. Listings expire after at most 90 days.
• Do not list material you know or suspect is contaminated or hazardous, and do not misrepresent where material came from or what condition it is in.
• We may edit or remove any listing, or suspend any account, at our discretion, including for breaking these terms.

4. Material, testing and compliance are your responsibility

Before you take, deliver or place any material, you and the other party are solely responsible for:

• deciding whether it is suitable for your use;
• any geotechnical, environmental or other testing;
• permits, and compliance with all laws on excavating, hauling, placing or disposing of fill, including environmental, erosion-control and transportation rules;
• any contamination, damage or loss that results.

DirtFlow makes no promise about any material, site, listing or user.

5. Permission to use your content

You keep ownership of what you post. You give DirtFlow a non-exclusive, royalty-free license to display, copy and share your listing content in the app and in DirtFlow's marketing, including social media posts. Marketing posts state only what your listing says and name your project only if you allow it when you post. Your contact details are not shown publicly, not given to other users, and not included in marketing posts. When someone asks to reach you, we pass their request to you.

6. Free service and match alerts

• Posting, browsing, match alerts and contact requests are free.
• If you have a listing, we email you when a new listing within 50 miles looks like a fit for it. We try to send alerts promptly but do not guarantee that every match will be found or that every alert will arrive.
• We may add paid features later. We will tell you before we charge you for anything.
• If you bought a DirtFlow subscription in the past, email dirtflow.app@hipointmapping.com to cancel it or to ask about a refund.

7. Acceptable use

You may not:

• post false, misleading or spam listings;
• use contact details from DirtFlow for anything other than dealing with the listing they belong to, or resell or share them;
• scrape, copy or bulk-download data from DirtFlow;
• try to get around DirtFlow's access controls or interfere with the service;
• harass other users or break the law.

8. Estimates and information are approximate

Distances, match suggestions and haul-cost estimates are rough guides. Actual costs and conditions vary. DirtFlow is provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows.

9. Limitation of liability

To the fullest extent the law allows, DirtFlow is not liable for any indirect, incidental, special or consequential damages, or for lost profits. It is also not liable for any loss arising from dealings between users or from the condition of any material. Our total liability for any claim relating to DirtFlow is limited to the greater of (a) what you paid us in the 12 months before the claim and (b) $100.

10. Indemnity

You agree to cover DirtFlow's losses and costs, including reasonable legal fees, from any claim arising out of your listings, your material, your dealings with other users, or your breaking these terms.

11. Ending your use

You can stop using DirtFlow at any time and ask us to delete your account (see the Privacy Policy). We may suspend or close accounts that break these terms.

12. Changes and transfer

We may update these terms and will post the new version here with a new effective date. If you keep using DirtFlow after a change, you accept the updated terms. We may transfer these terms to a new owner if DirtFlow or its assets are sold.

13. Governing law

These terms are governed by the laws of the State of Georgia, USA.
